Terms of Electronic Service Provision

1. General provisions

These Terms of Service set out the rules for the provision of services by electronic means by Viking Potatoes spółka z ograniczoną odpowiedzialnością, with its registered office in Warsaw (ul. Krypska 25/9, 04-082 Warsaw, Poland), entered in the register of entrepreneurs of the National Court Register under KRS 0000648228, NIP 5862312148, REGON 365907852, hereinafter referred to as the "Service Provider".

The Terms are drawn up on the basis of Article 8(1)(1) of the Polish Act of 18 July 2002 on the provision of electronic services.

2. Definitions

Service Provider - Viking Potatoes spółka z ograniczoną odpowiedzialnością, with the data indicated in Section 1.

User - a natural person conducting business activity, a legal person or an organisational unit using the Site in connection with its business or professional activity.

Consumer - a natural person within the meaning of Article 22^1 of the Polish Civil Code, who concludes a legal transaction with the Service Provider that is not directly connected with their business or professional activity. The Terms do not apply to services provided to Consumers - see Section 3 paragraph 3.

Sole trader treated as a consumer - a natural person concluding a contract directly related to their business activity, where the content of that contract shows that it does not have a professional character for them (Article 7aa of the Polish Act of 30 May 2014 on consumer rights).

Site - the website available at chcedointernetu.pl.

Electronic service - a service provided by electronic means by the Service Provider to the User via the Site.

Contact form - an interactive form on the Site enabling messages to be sent to the Service Provider.

Terms of Service - this document, available at https://chcedointernetu.pl/en/terms .

Privacy Policy - document setting out rules of personal data processing, available at /en/privacy-policy .

Cookie Policy - document setting out rules of using cookies, available at /en/cookie-policy .

UDU - the Polish Act of 18 July 2002 on the provision of electronic services.

GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

PrKonsum - the Polish Act of 30 May 2014 on consumer rights.

KC - the Polish Act of 23 April 1964 - the Civil Code.

3. Types and scope of electronic services

These Terms govern exclusively free-of-charge services provided by electronic means via the Site. Paid services (in particular: creation of websites, online stores, SEO optimisation, Google Ads and Meta Ads campaigns, AI consulting, automations, visual identity design) are governed by a separate agreement concluded individually with the Client. The provisions of such an agreement take precedence over the provisions of these Terms.

The Terms and the services provided via the Site are addressed to entrepreneurs within the meaning of Article 43^1 of the Polish Civil Code. The Service Provider does not provide services to Consumers.

In exceptional situations in which a contract is concluded with a Consumer or a sole trader treated as a consumer - such person is entitled to all rights arising from mandatory provisions of law, in particular the Polish Act of 30 May 2014 on consumer rights (including the right of withdrawal within 14 days under Article 27 of that Act, subject to the exceptions set out in Article 38 of that Act). Provisions of these Terms restricting the rights of a Consumer or sole trader treated as a consumer are ineffective against them.

The Service Provider provides the following free-of-charge electronic services via the Site:

Provision of information content - presentation of the offer, portfolio, blog and educational materials. Free of charge, available to every User.

Contact form - enabling sending an enquiry to the Service Provider. Free of charge. Requires: name, email address, optionally phone number and message content.

Project brief - interactive form for defining design needs. Free of charge.

Site quiz - tool for self-diagnosis of a website. Free of charge.

Free GEO audit - automated analysis of a site’s visibility in AI search engines. Free of charge. Requires a business email address and confirmation (double opt-in).

4. Conditions of service provision

Using the Site requires:

a device with internet access;

a web browser supporting JavaScript and cookies;

an active email address (when using forms).

The Service Provider makes every effort to ensure proper functioning of the Site. The Service Provider reserves the right to temporary technical breaks needed for maintenance or updates.

It is prohibited for the User to provide unlawful content, including content infringing third-party rights, vulgar content or content constituting spam.

5. Conclusion and termination of contracts

A contract for the provision of an information-content service is concluded when a page of the Site is displayed and terminated when the User leaves the Site.

A contract for the provision of the contact form, brief, quiz or GEO audit service is concluded upon completion and submission of the relevant form, and terminated upon the Service Provider’s response or upon expiry of the data retention period set out in the Privacy Policy .

The User may at any time resign from using the electronic services by leaving the Site or by sending a message to ratunku@chcedointernetu.pl .

6. Complaints

The User may submit complaints regarding services provided via the Site:

by email to ratunku@chcedointernetu.pl ;

in writing to the registered office address of the Service Provider.

A complaint should contain:

first and last name (or company name) of the User and contact details;

description of the circumstances forming the basis of the complaint and the date of their occurrence;

the resolution expected by the User;

signature (in the case of a written complaint).

The Service Provider examines complaints within 14 days of receipt. Failure to examine a complaint within that period means the complaint is upheld in line with the position of the submitting party.

The reply to the complaint is sent to the email address or postal address indicated by the User.

7. Personal data protection

The controller of Users’ personal data is Viking Potatoes spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw, NIP 5862312148, REGON 365907852, KRS 0000648228.

Where the Service Provider, in the course of providing a service, processes personal data on behalf of the User (e.g. data of the User’s clients - subscribers, store customers, ad leads) - the processing takes place on the basis of a separate data processing agreement concluded pursuant to Article 28 GDPR. A template processing agreement is available on request sent to ratunku@chcedointernetu.pl .

8. Intellectual property

The Site and its content (texts, graphics, photographs, logos, source code) are the property of the Service Provider or are used on the basis of relevant licences and are protected under the Polish Act on Copyright and Related Rights.

Copying, distribution or use of materials from the Site without the written consent of the Service Provider is prohibited, except for permitted personal use.

9. Liability

The Service Provider is not liable for:

technical interruptions in the operation of the Site resulting from force majeure or from causes attributable to third parties;

unintended errors or bugs in the Site’s software disclosed after its release, provided that the Service Provider takes steps to remove them within a reasonable time;

content placed by Users in contact forms, briefs and other tools;

damage resulting from improper use of the Site by the User or from a breach by the User of these Terms;

the consequences of applying in practice general information, hints or recommendations provided by the Site or the Service Provider, without prior individual analysis of the User’s situation;

damage in the form of lost profits (lucrum cessans).

The liability of the Service Provider is limited to actual damage (damnum emergens). This limitation does not apply in the case of intentional fault or gross negligence on the part of the Service Provider (Article 473 § 2 of the Polish Civil Code).

Content published on the blog and in educational materials is informational and educational in nature. It may include technical and specialised advice based on the experience of the Service Provider; however, it does not replace individual consultation taking into account the specifics of a particular situation.

10. Final provisions

The Service Provider may amend these Terms for important reasons, in particular: changes in legal regulations, introduction of new services or cessation of their provision, organisational or technical changes on the Service Provider’s side, or the need to comply with court rulings or administrative authority decisions.

The Service Provider informs Users about a change to the Terms at least 14 days before its entry into force by:

publishing the new version of the Terms on the Site, indicating the date of entry into force of the changes;

where the User has provided an email address - sending information about the change to that address.

The User may terminate the contract with immediate effect before the changes to the Terms come into force, if the User does not accept the new content. Failure to object within 14 days of the announcement of the change is equivalent to acceptance.

The provisions of the Terms as in force before the change apply to contracts concluded before the change comes into force, unless mandatory laws or a specific provision provide otherwise.

In matters not regulated by these Terms, the generally applicable provisions of Polish law apply, in particular:

the Polish Act of 23 April 1964 - the Civil Code,

the Polish Act of 18 July 2002 on the provision of electronic services,

Regulation (EU) 2016/679 of 27 April 2016 (GDPR).

Any disputes arising from the Terms or services provided via the Site will be settled by the common court competent for the registered office of the Service Provider.

These Terms come into force on 12 June 2026.
